These terms govern the purchase and use of the Algoryvo software licence through algoryvo.com. By completing a purchase you fully accept these terms.
1. Seller
[FULL NAME OR COMPANY NAME], Tax ID [TAX ID], with address at [FULL ADDRESS] and contact email [EMAIL] (the "Seller").
2. Subject: a software licence
What you purchase is a licence to use the Algoryvo computer program, an expert advisor for MetaTrader 5. No investment service is contracted: the Seller does not provide financial advice, portfolio management or order reception/transmission, and is not authorised or supervised by the CNMV or any other financial regulator.
The software is not configured or parameterised based on the client's personal information: capital, lot size and risk limits are decided and set by the client.
3. Purchase process
To buy you must create an account with a valid email and accept these terms and the risk warnings. Payment is processed by Stripe on its secure gateway: the Seller never sees or stores your card details.
Once payment is confirmed, the purchase is recorded in your client area.
4. Price and taxes
Prices shown include applicable taxes where indicated. The exact amount, taxes included, is always displayed before you confirm payment at the gateway.
5. Delivery
Delivery is digital: once payment is confirmed, the software becomes available for download from the client area. No physical product is shipped.
6. Scope of the licence
Unless the purchased package states otherwise, the licence allows use of the software on 1 live trading account and unlimited demo accounts, by the purchasing client.
The licence is personal and non-transferable. Reselling, renting, sublicensing, distributing or publishing the software is prohibited; so is decompiling or reverse engineering except where legally permitted, and removing ownership notices.
7. Subscriptions
If the purchased package is a subscription, it renews automatically at the end of each period (monthly or yearly) until cancelled. You can cancel at any time with effect at the end of the paid period; no further charges are made after cancellation.
8. Right of withdrawal
You have 14 calendar days to withdraw from the purchase without giving a reason, subject to the legal exception for digital content: if you request immediate download of the software and expressly consent to the start of performance, you lose the right of withdrawal from the moment of download. 9. Support and updates
The licence includes technical installation support and compatibility updates for new MetaTrader 5 builds. Updates never modify the software's behaviour remotely: you download and install any new version yourself, when you decide.
10. Use at the client's own risk
Trading leveraged instruments carries a high risk of loss, including possible loss of all capital deposited with the broker. Historical or simulated results do not guarantee future results.
The decision to activate the software, the broker used, the capital allocated and the configuration applied are the client's sole responsibility, as is supervising their account.
11. Warranty and limitation of liability
The software carries the legal conformity guarantee provided by consumer law for digital content and services. If the software does not work as described, the client may demand it be brought into conformity and, failing that, a price reduction or termination of the contract.
To the extent permitted by law, the Seller's total liability is limited to the amount paid for the licence. In no event is the Seller liable for trading losses, loss of profit or indirect damages arising from use of the software, whose results depend on the market and on the configuration chosen by the client.
12. Changes
The Seller may update these terms. Purchases are governed by the version in force at the time of purchase.
13. Applicable law
These terms are governed by Spanish law, without prejudice to the mandatory consumer rights of the consumer's country of residence. Disputes will be submitted to the competent courts; where you act as a consumer, those of your place of residence.
